Terms and Conditions of Service

SALES CONDITIONS

  1. General Information

1.1 The sale of products (hereinafter: “Products”) offered on our website (hereinafter: “Site”), identified by the brand (hereinafter: “Brand”), is governed by these general terms of sale (hereinafter: “General Conditions”).

  1. Commercial Policy

2.1 The sale of Products is exclusively intended for individual consumers (hereinafter: “Customers”). By Customer, we mean an adult individual acting for purposes unrelated to any commercial, business, or professional activity carried out.

2.2 In consideration of the above, Oneprime reserves the right not to process orders from individuals other than Customers.

2.3 Oneprime may amend or revise these General Conditions at any time. In any case, the Customer will be required to accept exclusively the General Conditions in force at the time of each Order.

2.4 Each Order may concern one or more Products, with Oneprime reserving the right to set a maximum number based on the product category.

2.5 Purchase requests from countries not enabled on the shipping address page will not be accepted.

2.6 Shipments of orders addressed to a post office box or when the recipient’s identity and address cannot be identified will not be made.

2.7 All communications specified in the General Conditions to be made by email will be sent to the email address provided by the Customer during registration.

  1. Purchasing Methods

3.1 Each Product offered for sale can be selected on a dedicated web page displaying photographic images, the unit price including VAT, available colors, and sizes (where applicable).

3.2 The images and colors of the Products offered for sale may, in some cases, not correspond to the actual ones due to technical characteristics and resolution of the computer equipment and software used by the Customer. Therefore, images and colors should be considered indicative, and the Customer is encouraged to verify the actual adherence of the selected Product to their expectations. Oneprime shall not be liable for any inadequacy of the images or colors of the Products due to the aforementioned technical reasons.

3.3 To place each Order regarding the selected Products, the Customer must carefully follow the instructions and procedures available on the Site.

3.4 The Customer is requested to verify the accuracy of the content of each Order before confirming it, completing the purchase form according to the instructions provided on the corresponding page of the Site.

3.5 If the Customer wishes to make changes or corrections to their Order before confirming it, they must request it from Oneprime. Generally, confirmed orders cannot be further modified or canceled, except as expressly provided by the General Conditions or by any Specific Provisions or in cases mandatorily provided by applicable Italian law.

3.6 At the end of the purchase procedure, the Customer will receive an email confirmation (hereinafter: “Email”) of the receipt of the Order placed, containing a summary of the information already contained in the Order form, i.e., the Customer’s data and shipping methods/addresses, and the essential characteristics of each Product purchased as well as detailed indications of the price and delivery costs.

3.7 Once the Order is entrusted to the courier, the Customer can monitor the status of their Order at any time by entering the tracking code on the courier’s website, if tracking is provided (variable depending on the product).

3.8 Each confirmed Order will be automatically sent to the relevant product company and will be archived at its operational headquarters after execution.

  1. End Consumer

Oneprime has created and published the website with the aim of offering a service reserved exclusively for its Customers. The products for sale on the Oneprime website are intended for the End Consumer. By End Consumer, Oneprime means an individual acting for purposes unrelated to their own business or professional activity. Oneprime therefore invites users who do not fall within the category of End Consumers to refrain from establishing commercial relationships with Oneprime or placing orders to purchase goods through third parties. In consideration of the commercial policy described above, Oneprime reserves the right not to process orders for goods not intended for the End Consumer or orders that do not comply with the commercial policies described above.

To place orders on Oneprime, Customers must:

  • Be the end customer as defined in the Commercial Policy of Oneprime.
  • Be at least 18 years old.
  • Possess the necessary requirements to enter into legally binding contracts.
  • Have a valid email address.
  1. Prices and Payment Methods

4.1 The prices of the Products offered for sale and indicated on the Site are inclusive of VAT.

4.2 The prices of the Products are expressed in EURO. The amount charged to the credit card or PayPal account may vary due to fluctuating exchange rates and bank charges.

4.3 Oneprime invites customers to contact their bank for detailed information on exchange rates and bank charges related to their transaction.

4.4 Oneprime reserves the right to change the prices of the Products offered for sale at any time and without notice. In any case, the prices published on the Site at the time of confirmation of each Order will apply to the Customer.

4.5 It is possible to choose one of the following payment methods:

  • Payment with PayPal; payment by Bank Transfer or credit/debit card. Oneprime reserves the right not to process the order if payment is not made.

4.6 With payment by Bank Transfer, the order will be processed only upon receipt of the email to the receipt address of the payment requested at the time of purchase. Otherwise, the order will be processed at the end of the month in which the order is placed.

4.7 The data of the PayPal card and the personal data of bank transfers are managed with the utmost confidentiality directly by the circuit manager. Oneprime is not responsible for any fraudulent and unlawful use of PayPal cards by third parties at the time of payment for products purchased on the site. In this regard, Oneprime reserves the right to cancel the transaction in case of suspected fraudulent use of the cards. To ensure greater security, additional information or documents may be requested at any time, without which, Oneprime reserves the right not to accept the transaction.

4.8 Order Modifications: We would like to remind our customers that once confirmed and processed, orders for already available items cannot be modified. Orders placed separately will be shipped separately.

  1. Transport and Delivery

5.1 Deliveries usually occur within a maximum of 7 days from the order date.

5.2 Once the order is entrusted to the courier or postal service, if tracking is provided for the specific product, the Customer will receive an email containing the tracking code that allows tracking the status of the shipment.

  1. Return

If for any reason the Customer is not satisfied with their purchase, unworn items can be returned for exchange or refund within 30 days of delivery.

Return Instructions

6.1 To request authorization for the return, the Customer must send a request to the address within 30 days of order delivery. The email must specify the names of the items to be returned and the desired compensation: size exchange, or partial/full refund. Upon receipt of the return request, Oneprime will send a written confirmation to the Customer via email.

6.2 Shipping costs will be borne by the customer; furthermore, it is advisable to provide a tracking number. We cannot be held responsible for lost or undelivered orders without identification and traceability.

For returns made for size exchange, the return shipment will be at the customer’s expense.

Size exchange is possible for a different size or color of the same item. The exchange and return option is valid for the first exchange related to an order within 30 days of delivery. The customer will bear the shipping costs.

For returns made for a refund with the motivation of the right of withdrawal, the shipment will be at the customer’s expense.

If the right of withdrawal is exercised and the item is returned within 30 calendar days of delivery, the cost of the item will be refunded. Additional cash on delivery charges and return shipping costs will not be refunded and will be borne by the buyer.

Shipping costs will be borne by the customer; furthermore, it is advisable to provide a tracking number. We cannot be held responsible for lost or undelivered orders without identification and traceability. If we do not receive the package within 30 days, the warehouse reserves the right to refuse the refund request.

Refund Methods

Before proceeding with the shipment of the goods, send an email requesting the withdrawal form, which must be completed and accepted before sending the package.

Refunds are processed within different time frames depending on the chosen refund method:

Payment Method – Refund Method – Expected Time (after receiving the return)

Bank Transfer/Credit Card – Issued within 2 days of receiving the goods at the warehouse; receipt based on your bank’s timing.

PayPal – Issued within 2 days of receiving the goods at the warehouse.

Voucher – Issued within 2 days of receiving the goods at the warehouse.

Working days will be subsequent to the date the return is delivered to the company headquarters.

Items must not have been worn, washed, or altered and must not show any signs of use.

Each item must be returned with all labels, packaging, and original accessories (Dustbags, hangers, garment covers, etc.) received with the order. All footwear and accessories must be returned with their original box, which is considered an integral part of the product itself and must not have been damaged or altered in any way, nor used as the sole outer packaging.

In the event that the Customer receives defective goods or there are errors in the shipments by Oneprime, they are required to follow the same instructions as stated above. Oneprime reserves the right to request photographic evidence before authorizing returns for defective goods and bear the shipping costs for the return of the goods to its premises.

Swimwear and intimate garments (bikinis, briefs, boxers, etc.) must be tried on over the customer’s personal underwear. Returns of such items will be refused and returned at the customer’s expense if the items show signs of use.

All returned items are inspected by Oneprime and must meet all the parameters listed in the return procedure. Oneprime reserves the right to impose a charge equal to 10% of the value of the returned goods in cases where the return does not comply with all the terms and conditions specified in our return policy.

Oneprime reserves the right to refuse unauthorized returns. The acceptance of such returns, however, entails a charge equal to 10% of the value of the returned goods.

  1. Liability for Defective Products

7.1 Pursuant to Italian law and in particular Legislative Decree no. 206 of September 6, 2005 (Consumer Code), Oneprime is responsible for any defect in the Products, including non-compliance of the products received by the Customer compared to those offered on the Site and ordered.

7.2 If one or more of the delivered Products do not correspond to those ordered, are damaged, or require return, the Customer must promptly inform Oneprime by writing to the email address.

7.3 Under article 130 of the Consumer Code, in case of defects, the Customer is entitled to have the goods restored at no cost, by replacement.

  1. Disclaimer

Oneprime publishes information on its website to provide a service to its customers; however, it disclaims all responsibility for any technical or factual inaccuracies and/or typographical errors for which, upon notification, immediate correction is provided. Oneprime also reserves the right to make corrections and changes to the site whenever deemed necessary without prior notice. Oneprime offers no guarantee of compliance of the information published on its site with the laws of the jurisdiction of the Customer’s country of residence. Oneprime disclaims all responsibility for any problems, damages, or risks that users may encounter while using the site. Oneprime guarantees that its website is protected according to the international standards provided for the Internet. If used correctly, the User is protected from the risk of viruses. Oneprime disclaims all responsibility for any malfunctions related to the deactivation of cookies in the user’s browser. Oneprime reserves the right to rectify/review the terms and conditions contained in this legal notice, through an update of the same, whenever deemed appropriate, without any obligation to give notice. Users are required to comply with the terms contained in this legal notice, periodically checking for any updates, changes, and corrections.

  1. Italian Law

The Oneprime website, adhering to Italian legislation, declares: “Users accessing this site declare that they accept that all matters relating to the use of the Oneprime website are governed by the current legislation of the Italian State. Oneprime makes no guarantee whatsoever that the content of the site complies with the laws in force in other countries. Access to the Oneprime site from locations where the content is considered illegal is expressly prohibited. Users who decide to access the site from such countries are fully aware of the legal consequences and sanctions they risk incurring and will be solely responsible for complying with local laws.”
